Carel E. Smith is associate professor Legal Theory at Leiden University. He is also Director of Research Programs of the Graduate School, and Dean of PhD candidates at the Meijers Research Institute of Leiden Law School. His research and teaching revolve around legal methodology and fundamental legal concepts. His current research “Certainty in Law: Metaphors, Institutions, and Exemplars” examines the way the production of legal meaning is constructed, and critiques the dominant approach in legal theory to frame it as a rational, rule-based activity. Borrowing from linguistics and philosophy of language, he analyses a series of debates on legal reasoning and legal phenomena by exposing the conceptual metaphors, deeply embedded in our language, that account for this approach.
